Please read these Terms. They include an assumption of risk, disclaimers, limits on our liability and a binding arbitration agreement with a class action waiver. You can opt out of arbitration by email within 30 days.
These Terms are an agreement between you and the operator of Ranked ("Ranked", "we", "us"), including any company we later form or transfer the Service to. They cover the Ranked app, rankedating.com and related services (the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy and our Community Guidelines. If you don't agree, don't use the Service. The only way to contact us is by email at support@rankedating.com.
1. Who can use Ranked
You may use Ranked only if you are 18 or older, can legally agree to these Terms, have not been convicted of a felony, violent crime or sexual offence, are not required to register as a sex offender, and have not been removed from Ranked before. One account per person. We may close any account we believe doesn't meet these requirements.
2. Your account
You must give accurate information, use photos of yourself, and keep your Apple or Google sign-in secure. You're responsible for everything that happens on your account. Accounts can't be shared, sold or transferred.
3. Rules and enforcement
You must follow our Community Guidelines. Ranked has zero tolerance for objectionable content and abusive users: no harassment, threats, hate, nudity or sexual content, scams, requests for money, selling, impersonation, content involving minors, illegal activity, bots, or interfering with the Service. We may remove content and suspend or ban accounts at our discretion, with or without notice. We may review reports and share information with law enforcement as described in our Privacy Policy. We aren't required to monitor the Service and can't catch everything.
4. Your content
You own what you post and are responsible for it. You confirm you have the right to post it. You give us a worldwide, royalty-free, non-exclusive licence to host, store, display, adapt and distribute it to operate, improve and promote the Service. The licence ends when you delete the content, except for copies we keep as described in our Privacy Policy. If you believe content infringes your copyright, email us with the details at support@rankedating.com. We remove infringing content and ban repeat infringers.
5. Ranks and matching
Every profile shows a 1–10 rank generated automatically from activity on the Service. A rank is an in-app feature only. It is not a statement by us about anyone's attractiveness, character or worth. Ranks can change at any time. We don't guarantee any rank, matches or results. You can have up to 20 active matches at a time. We may change how ranks, matching or any feature works at any time.
6. Your safety
We do not conduct criminal background checks or identity checks on members, and we do not verify what members say about themselves. Verification only confirms control of a phone number. You are solely responsible for your interactions with other members, online and in person. Read our Safety Centre before meeting anyone.
7. Assumption of risk and release
Meeting people online and in person carries risks, including harm caused by other people. To the fullest extent permitted by law, you assume those risks and release Ranked and its owners, operators, employees and agents from all claims, known and unknown, arising from the conduct of any member or third party, on or off the Service. California residents waive California Civil Code §1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law elsewhere.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted, secure or error-free, that any member is who they say they are, or that you will find a match.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, lost profits or data, personal injury or emotional distress arising from your use of the Service or the conduct of any member or third party, on or off the Service. Our total liability for any claim is limited to US$100.
Some places don't allow these limits, so they apply only as far as the law allows. Nothing here limits liability that can't legally be limited.
10. Indemnity
You agree to cover us for any claims, losses and legal costs arising from your use of the Service, your content, your conduct towards other members, or your breach of these Terms or the law.
11. Arbitration and opt-out
Try email first. Before bringing any claim, email support@rankedating.com with the subject "Dispute", describing the issue and what you want. We'll both try to resolve it in good faith for 60 days.
Arbitration. If we can't resolve it, any dispute about the Service or these Terms will be settled by binding individual arbitration run by the American Arbitration Association under its Consumer Arbitration Rules, not in court. The arbitration can happen online or in the county where you live. We'll pay any arbitration fees above what a court filing would cost you, unless your claim is frivolous. Either of us may instead use small claims court, or go to court to stop misuse of intellectual property. The Federal Arbitration Act applies.
Class action and jury waiver: claims may be brought only individually, not as part of any class, collective or representative action, and you and we both waive the right to a jury trial.
30-day opt-out. You can opt out of this section by emailing support@rankedating.com with the subject "Arbitration opt-out" within 30 days of creating your account. Include the phone number or email on your account. If the class action waiver is found unenforceable for a claim, that claim goes to court and this section doesn't apply to it.
12. Everything else
- Ending your account. You can delete your account at any time in Settings → Delete account. We may suspend or end your access at any time. Sections 4 and 6 to 12 survive termination.
- Changes. We may update the Service and these Terms. We'll tell you in the app or by email about important changes. Continuing to use Ranked means you accept them.
- Fees. Ranked is currently free. If we add paid features, we'll show the price and terms before you buy.
- Messages from us. You agree to receive verification codes, notifications and notices electronically. Carrier rates may apply.
- Governing law. These Terms are governed by U.S. federal law, including the Federal Arbitration Act, and the laws of the U.S. state where you live. Any claim not subject to arbitration will be heard in the courts of the county where you live.
- Apple. These Terms are between you and us, not Apple. Apple isn't responsible for the app, its content, maintenance, support, warranty or any claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
- Our property. The app, name, logo and design belong to us. You get a personal, revocable licence to use the app for its intended purpose.
- General. These Terms, the Privacy Policy and the Community Guidelines are the whole agreement between us. If any part is unenforceable, the rest still applies. Not enforcing a term isn't a waiver. We may transfer these Terms, for example to a company we form. You may not transfer them.
- Contact. Email support@rankedating.com. This is our only contact channel, and it's the address for all notices.
